Privacy Policy

Preamble

This Privacy Policy is incorporated into the General Terms and Conditions of Use and Sale and shares the same definitions. This policy aims to inform users about the collection and processing of their personal data by Bytecloud Saas LTD (hereinafter “the Company”), as well as their rights related to this collection and processing.

Definitions

  • Intermediate Archiving : refers to the temporary storage of data in a separate database when their administrative interest persists (e.g., in case of litigation), before their deletion or anonymization.
  • General Terms and Conditions : refers to the General Terms of Use, the General Terms of Service and the General Terms and Conditions of Sale.
  • Personal Data : refers to any information relating to a natural person that allows him or her to be identified.
  • Specific Rights : refers to the user's rights concerning their personal data, detailed in Article IX.
  • Personal Data Regulations : refers to British laws (Law No. 78-17) and the General Data Protection Regulation (GDPR).

1. Legal basis for data processing

The processing of personal data carried out by the Company is based on the following legal grounds:

  • Consent : User consent is required for certain specific purposes.
  • Contractual execution : certain data is required for the execution of services and the management of the contractual relationship.
  • Legal obligations : certain data must be retained to comply with legal obligations, such as the retention of site access logs.
  • Legitimate interests : The Company may process certain data to prevent fraud and for purposes necessary for its legitimate interest, in compliance with the user's rights.

2. Purposes of data processing

Personal Data is used for:

  • Customer relationship management : order processing, invoicing, customer follow-up and satisfaction surveys.
  • Customer loyalty and prospecting activities : conducting surveys and sending promotional materials.
  • Personalization and marketing : adapting communication according to user preferences.
  • Management of specific rights : processing of requests for access, rectification and erasure of data.
  • Combating fraud : detection and prevention of fraudulent behavior.

3. Data Collection and Storage

Labonas collects the following Personal Data that the Customer and Subscriber enters and provides during their browsing:

  • Sex,
  • Date of birth,
  • Email address,
  • Identifier used on the Site,
  • Payment ID,
  • Delivery address,
  • Billing address,
  • Phone number,

Personal data is stored for a period of three (3) years from the user's last connection.

Some data is archived for an additional period of two (2) years to meet legal requirements:

  • Invoices,
  • Amount of transactions carried out, as well as the date and time of these transactions,
  • And up to seven (7) years for accounting documents.

4. Data Recipients

The data may be transmitted to third parties in order to ensure, in particular:

  • the shipment of the products;
  • the fight against fraud,
  • after-sales service, etc.

The data may be transmitted for the following purposes:

Order processing: transmission of information to service providers:

  • delivery: for the delivery of products.
  • payment: to secure bank transactions for Customers and Subscribers.

Marketing actions: use of advertising partners such as Facebook, Google, TikTok and Pinterest.

5. Data Security

The Company uses encryption technologies and security measures to protect personal information. During bank transactions, payment data is transmitted directly to the secure payment provider, without the Company having access to it.

6. User Rights

In accordance with the GDPR, users have the following rights regarding their personal data:

  • Right of access : the user can obtain confirmation that their data is being processed and obtain a copy of it.
  • Right of rectification : the user can request the correction of their personal data.
  • Right to erasure : the user can request the deletion of their data, except in cases of legal obligations to retain it.
  • Right to restriction : the user can limit the processing of their data in certain cases.
  • Right to data portability : the ability to retrieve one's data in a structured and commonly used format.
  • Right to object : the user may object to the processing of their data based on the legitimate interest of the Company.

These rights can be exercised by email at contact@labonas.com or by post to 85 Great Portland Street, London, England, W1W 7LT. A response will be provided within one month, with a possible two-month extension if necessary.

7. Password Security

Passwords must have a minimum complexity of eight characters, including uppercase letters, lowercase letters, numbers and special characters.

8. Use of cookies

Cookies are used to improve the user experience. They collect anonymous information about the type of device, the browser used, the IP address, and language preferences.

More specifically, the Personal Data collected from cookies issued by Labonas or third parties allows:

  • To establish statistics and volumes of traffic and use of the Site in order to improve the interest and ergonomics of the services;
  • To adapt the presentation of the Site to the display preferences of the Terminal of the Person Concerned (language used, display resolution, operating system used, etc.);
  • To remember information relating to a form completed by the Person Concerned on the Site (registration or access to your account);
  • to implement security measures, for example when the Data Subject is asked to log back into the Site after a certain period of time;

Through the use of cookies, Labonas collects and processes, for the purposes specified above, all or part of the following Data:

  • Information related to the Data Subject's Terminal and/or the Data Subject:
  • Its type of terminal (smartphone, tablet, computer, etc.);
  • Its operating system (Mac OS, iOS, Android, Windows, BlackBerry etc.);
  • The categories and versions of its Terminal plug-ins,
  • His/her Internet service provider (Orange, SFR, Bouygues, Free, etc.);
  • The browser he uses (Safari, Chrome, Internet Explorer, etc.);
  • His advertising identifier linked to the operating system of his terminal;
  • The IP address of his terminal;
  • His language preferences.

Information about his browsing and behavior on the Site:

  • Statistics on the viewing of the different pages of the Site;
  • The complete URL path to, through and from the Site;
  • Information concerning the Person Concerned (age or age range, sex, declared and/or presumed socio-professional category, presumed interests, etc.) related to their activity on the Internet and communicated by third parties (advertisers, advertising agencies, etc.).

The storage period for cookies is limited to thirteen (13) months. Users can manage their cookie preferences directly in their browser or via the site settings.
