General terms and conditions of sale
1. Introduction
These General Terms and Conditions of Sale (GTC) aim to define the rights and obligations of Bytecloud Saas LTD and its customers in the context of the sale of physical products offered exclusively online on the website labonas.com.
The general terms and conditions apply to all sales made in France, Belgium, Switzerland, and Luxembourg, to individual customers.
2. Acceptance of the General Terms and Conditions of Sale
Any order placed on the labonas.com website implies the customer's full and unreserved acceptance of these General Terms and Conditions of Sale. The customer acknowledges having read the General Terms and Conditions of Sale before validating their order.
3. Products
Nature of the products: The products offered for sale are physical products available online exclusively at labonas.com.
Product availability: Products are available while supplies last. If a product becomes unavailable after an order is placed, Bytecloud Saas LTD will inform the customer as soon as possible by email or telephone. The customer may then cancel or modify their order if the product is out of stock.
4. Customer Account and Order
Automatic account creation: Upon order confirmation, a customer account is automatically created for the user. The personal information required to open the account is secured in accordance with applicable data protection regulations.
Ordering process: To place an order, the customer selects the desired products, which are added to their shopping cart. Before finalizing the order, a summary of the ordered products and applicable fees will be displayed. Order confirmation finalizes the sales contract.
5. Delivery
Delivery area: The products are delivered to France, Belgium, Switzerland and Luxembourg.
Delivery times: Delivery times are estimated between 4 and 7 working days from order confirmation, unless otherwise indicated during the ordering process.
Delivery method: The products will be shipped to the address provided by the customer when placing the order. Bytecloud Saas LTD cannot be held responsible for input errors and the resulting delays or delivery errors.
6. Payment terms
Accepted payment methods: Orders on labonas.com are paid for online by credit card (Visa, MasterCard, etc.), bank transfer, or any other payment method offered at the time of ordering.
Payment debit: The total order amount is debited upon order confirmation. The customer guarantees that they are fully authorized to use the provided payment method and that it provides access to sufficient funds to cover the order costs.
Payment security: Bytecloud Saas LTD uses a secure system to protect information related to online payments. All data relating to bank transactions is processed securely and encrypted.
7. Right of withdrawal
Conditions of withdrawal: In accordance with applicable legal provisions, the customer has a period of fourteen (14) calendar days to exercise their right of withdrawal, without having to justify reasons or pay penalties, from the date of receipt of the products.
Terms and conditions for exercising the right of withdrawal: To exercise their right of withdrawal, the customer must notify their decision in writing, either by email or via the contact form available on the website. An acknowledgement of receipt of this request will be sent without delay.
Product returns: Products must be returned in their original condition, complete and unused, within fourteen (14) days of notification of withdrawal. Return shipping costs are the responsibility of the customer, except in the case of a defective product or a delivery error attributable to Bytecloud Saas LTD.
Refund : Bytecloud Saas LTD will refund the amounts paid, including the initial delivery charges, within fourteen (14) days of receiving the returned products or proof of shipment provided by the customer.
8. Return and Exchange Policy
General return conditions: Apart from the right of withdrawal, products may be returned in case of defect or delivery error within 30 days of receipt.
Products not eligible for return: Products damaged by the customer or personalized products cannot be returned or refunded, except in the case of a hidden defect.
Return Procedure: To initiate a return, the customer is asked to contact customer service at contact@labonas.com , providing details about the product in question and the reason for the return. Returns must be sent to the address indicated by customer service.
9. Legal and contractual guarantees
Legal guarantee of conformity: In accordance with Articles L. 217-4 to L. 217-14 of the French Consumer Code, the customer benefits from a legal guarantee of conformity, valid for two (2) years from the date of receipt of the product. In the event of a lack of conformity, the customer may choose between repair or replacement of the product, subject to the cost conditions stipulated by law.
Legal guarantee against hidden defects: In accordance with Articles 1641 to 1649 of the Civil Code, the customer also has a guarantee against hidden defects, valid for two (2) years from the discovery of the defect. If the customer discovers a hidden defect, they may request the cancellation of the sale or a price reduction.
Contractual Warranty (if applicable): In addition to the statutory warranties, Bytecloud Saas LTD offers an additional commercial warranty for labonas.com member customers. The terms, duration, and implementation procedures for this warranty are specified in the General Terms and Conditions. This warranty does not cover damages resulting from misuse, accident, or negligence on the part of the customer.
10. Form for exercising the right of withdrawal
Model withdrawal form: In accordance with Article L. 221-18 of the French Consumer Code, the customer may use the form below to exercise their right of withdrawal. This form must be completed and sent by email to contact@labonas.com or by post to the following address: 85 Great Portland Street, London, England, W1W 7LT.

11. Applicable Law and Dispute Resolution
Applicable Law: These General Terms and Conditions of Sale are governed by British law. In the event of a dispute, the parties agree to seek an amicable solution before taking any legal action.
Dispute Resolution: In the event of a complaint, the customer can contact customer service at contact@labonas.com or +33 4 12 38 05 79, Monday to Friday (9:30 a.m. to 12:00 p.m. and 1:00 p.m. to 5:30 p.m.). In accordance with Articles L. 612-1 et seq. of the French Consumer Code, if the complaint to customer service is unsuccessful or if customer service does not respond within two (2) months, the customer may submit their complaint free of charge to the consumer mediator for Bytecloud Saas LTD. The mediator's contact information will be provided upon request.
Jurisdiction: In the event of an unresolved dispute, the British courts shall have sole jurisdiction.
